Terms of Service, Data Rights Assignment & Liability Waiver
1. Data Collection Description. As a remote data collector, you will use your own Android smartphone and the designated application to record egocentric video and sensor data (including audio, video, accelerometer, and gyroscope data) while performing everyday household tasks at your own residence. If the Company provides a headband mount, it is an irrevocable gift to you; the Company retains no ownership interest.
2. Irrevocable Data Rights Assignment. You irrevocably assign, transfer, and convey to the Company all right, title, and interest in and to all recordings, data, and materials created during your participation, including all intellectual property rights. This assignment is absolute, perpetual, worldwide, and royalty-free. The Company may use, reproduce, modify, sell, license, sublicense, and otherwise exploit all work product without restriction, including for AI/robotics training and any other purpose.
3. No Additional Compensation. You will be compensated at $20/hour of approved footage. Only recordings that meet the Company's quality standards will be eligible for payment. This is your sole compensation. You shall receive no royalties, residuals, or additional payments if the Company sells, licenses, or monetizes your data.
4. Complete Assumption of Risk. You assume all risks associated with participation, including physical injury from wearing the headband device, property damage, and any other harm, whether known or unknown, foreseen or unforeseen.
5. Release of Liability (Ordinary Negligence Only). You release and waive all claims against the Company and its affiliates, officers, directors, employees, and agents from any liability arising from ordinary negligence related to your participation. This release does not apply to claims arising from the Company's gross negligence, recklessness, intentional torts, or willful misconduct.
6. Indemnification. You agree to indemnify, defend, and hold harmless the Company from all claims, liabilities, damages, and expenses arising from your participation, breach of this agreement, or violation of any law or third-party rights.
7. Independent Contractor Status. You are an independent contractor, not an employee. You are solely responsible for all taxes, including self-employment and income taxes. The Company will not withhold taxes or provide employment benefits.
8. Binding Arbitration & Class Action Waiver. Any dispute shall be resolved by binding arbitration in Alameda County, California. You waive any right to a jury trial and any right to participate in a class action.
9. Biometric Data & Prohibited Recordings. You consent to the collection of biometric identifiers for AI training. You agree NOT to record in bathrooms or locker rooms, record any person under 18, record nudity, or record any third party without their verbal permission. Violation is grounds for immediate termination without pay.
10. Governing Law & Additional Terms. This agreement is governed by California law. If any provision is unenforceable, remaining provisions remain in full force. This constitutes the entire agreement between you and the Company.
